Tennessee’s Dog Bite Laws

All dogs have the potential to bite — regardless of their size, breed, or age. However, some dogs are more prone to it than others. In the state of Tennessee, you may be entitled to damages if a dog with any history of aggression bites you at the owner’s private property. This is called the “one-bite” rule. The idea is that a dog that has bitten someone in the past has demonstrated the potential to bite. Thus, they need to be properly secured when guests enter the property. If not, the owner can be held at fault for the attack. However, “biting” isn’t the only way to demonstrate aggression. You may still be able to hold a dog owner liable if their pet has shown violent or territorial behaviors in the past and the owner didn’t take proper precautions to prevent an attack. 

Outside of private property, the law changes. Owners are subject to “strict liability.” This means that dog owners are responsible for almost all unprovoked injuries their pet causes while in public.
